Hill Rivkins Prevails on Appeal in the M/Y JAMAICA BAY Litigation

On June 29, 2015, the U.S. Court of Appeals for the Ninth Circuit issued an Opinion reversing the order of the U.S. District Court for the District of Oregon and remanding for further proceedings. On interlocutory appeal, the Ninth Circuit determined that the Interior Outfit of the M/Y JAMAICA BAY, which was purchased from and installed by owner CHMM, LLC’s contractors, is not part of the relevant product purchased from the German shipbuilder but rather is “other property” for which damages may be recovered under maritime products liability law. Anthony Pruzinsky argued the case before the Court of Appeals, assisted by Brian Eisenhower on the briefs. Defendant’s petitions for panel and en banc rehearing were denied on August 5, 2015.
